A professional service to legal counsel in a broad range of equestrian topics is based on formal education and years of experience as an equestrian professional.
Consultant - The services include fee based consulting, providing background information and resources to assist in the development and understanding of a current or potential legal matter.
Expert Review and Report - Some legal counsel require a review of documentation and preparation of a written opinion(s) pertaining to their legal matter. Besides providing a thorough understanding of standards of operations of equestrian activities (best practices), the use of scientific information to substantiate and support the standard accepted practices is applied when available.
Expert Testimony Depositions and Trial - Testimony at a deposition or in the court during a trial completes the traditional services offered to defendants and plaintiffs in legal matters.
In the past 22 years, expert witness services have been offered to over 100 legal matters, with nearly a 50-50 split of defendant vs plaintiff representation. Court appearances have been made in Federal and State courts, with overall support provided in 27 states and 2 foreign countries. The Federal cases involved the Internal Revenue Service with challenges of horse farm business, the hobby loss factors.
The other types of cases range from personal injury to death of a rider, from falls from a horse to broken tack and equipment, and from parades and competition to recreational riding and lesson programs. A full range of equestrian activities which involves the beginner rider, the amateur owner, the jockey, the harness racing driver, the professional horse trainer, equine veterinarian and farrier.
Not all legal matters are accepted due a variety of circumstances ranging from conflict of interest to a contrary position and/or opinion on the topic from the representing attorney. Some matters are declined due to the unavailability on calendar dates.
